Bollettino 231

26 ottobre 2026 · finestra osservata: 19 – 26 ottobre 2026

Bollettino n. 11

Decree-Law No. 190 of 22 October 2026 — Urgent provisions on public security and the countering of juvenile crime (GU Serie Generale No. 246 of 22 October 2026, editorial code 26G00214; in force 23 October 2026, the day after publication, under Article 10). Ten articles, read in full.

It does not amend Legislative Decree 231/2001 and it creates no predicate offence. This must be said plainly, because the decree does create two new criminal provisions.

New Article 420-bis of the Criminal Code — "Organised violence at public demonstrations" (inserted by Article 1(4)). First paragraph: "Salvo che il fatto costituisca più grave reato", whoever, in the course of a demonstration in a public place or a place open to the public, taking part in a group of at least five persons operating in an organised manner, even occasionally, unlawfully uses sticks, clubs, blunt objects or objects otherwise capable of causing injury, or throws such objects or rockets, fireworks, firecrackers or devices capable of nebulising gases containing irritant active substances, thereby creating a concrete danger to the safety of persons and also causing damage to property, is punished with imprisonment from two to five years and a fine from EUR 10,000 to EUR 20,000. The penalty is increased by one third to one half where (a) the offenders act with their faces covered or otherwise so as to hinder identification, or (b) the throwing or use is directed against infrastructure for the supply of energy, transport services, telecommunications or other public services, or against movable or immovable property used for public functions, public service or public utility, or exposed to public trust. Second paragraph: whoever, including by electronic or telematic means, organises or promotes the formation of the group, or incites or instigates the conduct, is punished with imprisonment from four to twelve years. Third paragraph: where the conduct causes personal injury, the penalties under Articles 582, 583, 583-quater and 583-quinquies are increased by one third to one half.

New Article 635.1 of the Criminal Code — "Damage to property committed by an organised group" (inserted by Article 1(6)): where the conduct under Article 635, first, second and third paragraphs, is carried out by an organised group, even occasionally, of at least five persons, the penalty is increased by one third to one half.

Other amendments. Article 1 also amends Article 98 of the Criminal Code — for persons aged fourteen to eighteen, the capacity to understand and to will "si presume fino a prova contraria" — and Articles 419, 420, 582 and 635. Article 2 amends the Code of Criminal Procedure (deferred arrest in flagrante on the basis of video and photographic evidence; pre-trial custody available for the new offences); Article 3 amends Presidential Decree No. 448/1988 on juvenile proceedings; Article 4 amends Royal Decree No. 12/1941; Article 5 introduces an administrative penalty and a payment injunction against the parents of minors; Article 6 amends Legislative Decree No. 159/2011; Article 7 amends Article 11-bis of Decree-Law No. 59/1978; Article 8 concerns additional military personnel in Milan; Articles 9 and 10 are the financial-neutrality clause and entry into force.

Expected effect: none today. Neither Article 420-bis nor Article 635.1 is referenced by any provision of Legislative Decree 231/2001. Article 24-ter lists Articles 416, 416-bis, 416-ter and 630 of the Criminal Code and Article 74 of Presidential Decree No. 309/1990, not Article 420-bis; Article 24-bis lists the computer-damage offences of the 635-bis series, not Article 635 or Article 635.1. The item is nonetheless a watch item, for one structural reason: a decree-law is the ordinary vehicle by which a new offence is added to the 231 catalogue during conversion, and a new organised-group offence punished with four to twelve years is exactly the kind of provision an amendment would attach to Article 24-ter. Conversion deadline: 21 December 2026.

Legislative Decree No. 188 of 8 October 2026 — Complete adaptation of national law to Regulation (EU) 2023/1543 on European production and preservation orders for electronic evidence in criminal proceedings (GU Serie Generale No. 244 of 20 October 2026, editorial code 26G00205; entry into force 4 November 2026). Six articles, read on the official Gazzetta PDF: "Oggetto e ambito di applicazione", "Informazioni all'interessato", "Sanzioni amministrative", "Mezzi di ricorso", "Misure per l'attuazione del capo V del regolamento", "Clausola di invarianza finanziaria".

It does not amend Legislative Decree 231/2001 and it creates no offence. It does, however, create a new administrative pecuniary channel against legal persons — service providers — and that channel is turnover-indexed.

Article 3(1): fixed brackets. Breach of the transmission duties under Article 10(2), (3) and (4) of the Regulation: EUR 25,000 to 100,000. Breach of the information and communication duties under Article 10(5) to (8): EUR 10,000 to 50,000. Breach of the preservation duties under Article 11(1) and (2): EUR 100,000 to 1,000,000. Breach of the information and communication duties under Article 11(4) to (7): EUR 10,000 to 50,000. Breach of the duties under Article 13(4): EUR 500,000 to 1,000,000. Non-compliance under Article 16(10): EUR 600,000 to 1,200,000.

Article 3(3): the turnover cap. Where two or more of the aggravating circumstances of paragraph 2 apply, or the case is of particular gravity — for example where the conduct permanently prevented acquisition of the data or caused its permanent loss — a fine of up to 2% of the provider's worldwide turnover in the financial year preceding the ascertainment of the violation applies, but only where that amount exceeds the maximum laid down for the specific violation.

Expected effect: it moves no 231 figure. It is the fifth instance of the same structural point recorded at §1.2 of Bulletin No. 10 — an exposure that attaches to the entity, is indexed to worldwide turnover, and lives entirely outside the quota system.

Correction to Bulletin No. 10, channel 2. The new Articles 240-ter and 240-quater of the Criminal Code are not general instruments: each carries a closed list of predicate offences, and both lists reach market abuse.

Why this is a correction and not news. Bulletin No. 10 reported the two new articles from a truncated rendering of the Gazzetta PDF, in which the converter declared it could not reproduce them in full, and described them as two "new general confiscation instruments". They are not general. Both have now been read on the official Gazzetta PDF, Serie Generale No. 241, page 9, Title II.

On conviction or on a plea bargain under Article 444 of the Code of Criminal Procedure for one of a listed set of offences, where the things which served or were destined to commit the offence cannot be confiscated, the court confiscates assets or other benefits at the offender's disposal, including through an intermediary, for a value equivalent to that of the instrumentality, having regard to the gravity of the offence and to the convicted person's economic and financial circumstances. The second paragraph extends the same regime to the facilitation of irregular immigration (Article 12(1), (3), (3-ter) and (12-bis) of Legislative Decree No. 286/1998), to the market abuse offences of the TUF, to certain excise and customs offences, to offences concerning weapons, ammunition and explosives, and to Articles 255-bis, 255-ter and 259-bis of Legislative Decree No. 152/2006.

On conviction or plea bargain for one of a listed set of offences, where confiscation of the price, product or profit must be ordered and the defendant has no assets of equivalent value, including through an intermediary, the court may reach assets transferred to a person extraneous to the offence in order to shield them from confiscation, but only where it is established that the third party, at the time of the transfer, knew the defendant's purpose. The first paragraph's list, read on the Gazzetta PDF, comprises Articles 275-bis, 275-ter, 275-quater, 275-quinquies, 280, 280-bis, 289-bis, 305, 306, 316, 316-bis, 316-ter, 322-bis, 414-bis, 416 (where directed at offences punishable by imprisonment of not less than four years), 416-bis, 452-bis, 452-quater, 452-sexies, 452-quaterdecies, 453, 461, 493-ter, 493-quater, 600, 600-bis, 600-ter, 600-quater, 600-quater.1, 600-quinquies, 601, 602, 609-undecies, 615-ter, 615-quater, 617, 617-bis, 617-ter, 617-quater, 617-quinquies, 617-sexies, 628-bis, 635-bis, 635-ter, 635-quater, 635-quater.1, 635-quinquies, 640-bis, 640-quater, 648-bis, 648-ter, 648-ter.1 of the Criminal Code and Articles 2635 and 2635-bis of the Civil Code, plus offences committed for the purposes of terrorism, including international terrorism, or subversion of the constitutional order. The second paragraph adds, as for Article 240-ter, the immigration offences, the market abuse offences of the TUF, Articles 84 and 86 of Legislative Decree No. 141/2024, the weapons offences and Articles 255-bis, 255-ter and 259-bis of Legislative Decree No. 152/2006.

What this changes, stated precisely. (i) No 231 ceiling moves. The catalogue is unchanged. (ii) The families affected are far more numerous than Bulletin No. 10 recorded, and they are identifiable one by one rather than by a general clause: within the Article 240-quater list alone, Articles 316-bis, 316-ter and 640-bis are predicates under Article 24; 615-ter, 615-quater, the 617 series and the 635-bis series under Article 24-bis; 416 and 416-bis under Article 24-ter; 322-bis under Article 25; 453, 461 and 493-ter under Article 25-bis; Articles 2635 and 2635-bis of the Civil Code under Article 25-ter, letter s-bis); the 600 series, 601, 602 and 609-undecies under Article 25-quinquies; 648-bis, 648-ter and 648-ter.1 under Article 25-octies; 452-bis, 452-quater, 452-sexies and 452-quaterdecies under Article 25-undecies. (iii) Market abuse is in both lists and was absent from Bulletin No. 10's account. It is a 231 predicate under Article 25-sexies, and it is the family on which the oldest open item of this series already sits. (iv) Effective 31 October 2026.

Legislative Decree No. 189 of 7 October 2026 replaces Article 187-ter.1 of the TUF. Consob's administrative fines on companies and entities for MAR breaches are now turnover-indexed. In force 22 October 2026, inside this window.

Extremes. Transposition of Directive (EU) 2024/2810 on multiple-vote share structures and adaptation of national law to Regulation (EU) 2024/2809 — the Listing Act. GU Serie Generale No. 245 of 21 October 2026, editorial code 26G00206; entry into force recorded by the Gazzetta's own act page as 22 October 2026. Four articles: Article 1 transposes the directive, Article 2 adapts national law to the Regulation, Article 3 is the financial-neutrality clause, Article 4 entry into force. Read on the official Gazzetta PDF.

Article 2(1)(b) substitutes Article 187-ter.1 of the TUF in its entirety. For companies and entities: breach of Article 16 of Regulation (EU) No. 596/2014, EUR 5,000 to EUR 2,500,000, or up to 2% of turnover; breach of Article 17, from EUR 5,000 up to 2% of turnover, and where the turnover-based amount is disproportionately low Consob may impose up to EUR 2,500,000, or up to EUR 1,000,000 for SMEs; breach of Articles 18 and 19, from EUR 5,000 up to 0.8% of turnover, and where disproportionately low, up to EUR 1,000,000, or EUR 400,000 for SMEs; breach of Article 20, EUR 5,000 to EUR 1,000,000, or up to 0.8% of turnover. For natural persons (paragraph 3): Articles 16 and 17, EUR 5,000 to EUR 1,000,000; Articles 18, 19 and 20, EUR 5,000 to EUR 500,000. Turnover is relevant where determinable under Article 195(2) (paragraph 2). Where the advantage obtained exceeds the statutory maximum, the fine may reach three times that advantage, provided it is determinable (paragraph 5). Failure to observe the measures under Article 30(2) of the Regulation increases the fine by up to one third (paragraph 7).

Article 2(1)(c) amends Article 187-quater of the TUF, the accessory disqualification: financial advisory firms are added alongside pension funds, benchmark administrators and supervised contributors are added, and independent financial advisers are added. No amounts are involved.

It does not amend Articles 184 and 185 of the TUF, and it does not amend Legislative Decree 231/2001. Those two articles are the predicate offences referenced by Article 25-sexies of Legislative Decree 231/2001, and they are untouched: the entity's 231 pecuniary bracket for market abuse does not move.

Expected effect. (i) No 231 figure changes. (ii) The parallel administrative channel on the same facts does change, and it changes in the direction the 231 ceilings do not capture: Consob's exposure against the entity for MAR breaches is now expressed as a percentage of turnover with a fixed-amount fallback, rather than as a fixed ceiling. (iii) This is the fourth instance on the record — market abuse, artificial intelligence, confiscation on predicate offences, and now a second market abuse instance — and it lands on the family that already carries the series' oldest unresolved item: the Italian market abuse ceiling of EUR 15,000,000, open since Bulletin No. 1 and already disturbed by Legislative Decree No. 128/2026, which the catalogue repertory records as having amended Articles 187-ter.1 and 187-quinquies of the TUF. That item can no longer be left pending: two decrees in four months have now rewritten the same provision.

1.3 Normativa di settore sulle aree di processo

Controllato.

Article 23 of Legislative Decree No. 179/2026 — "Sanzioni amministrative pecuniarie" — read in full at the fifth attempt. The 7% figure leaves single-source status.

Each bracket opens with "salvo che il fatto costituisca reato". Prohibited practices under Article 5 of the AI Act: up to EUR 35,000,000 or, if higher, up to 7% of total worldwide annual turnover for the preceding financial year. Obligations under Articles 16, 22 to 26, 31, 33(1), (3) and (4), 34, 50, 73 and 80 of the AI Act: up to EUR 15,000,000 or, if higher, up to 3% of turnover. Inaccurate, incomplete or misleading information supplied to notified bodies or competent authorities: up to EUR 7,500,000 or, if higher, up to 1% of turnover. Obligations under Articles 27 and 86 of the AI Act — fundamental-rights impact assessment and the right to an explanation: up to EUR 1,000,000 or, if higher, up to 0.5% of turnover. Turnover is the total worldwide annual turnover as defined by Article 99 of the AI Act (paragraph 5); the amount is set under the criteria of Article 99(7) and by reference to whether the obligation breached is substantive or formal (paragraph 6); for SMEs, micro-enterprises and innovative start-ups the criterion of Article 99(6) applies (paragraph 7).

Who imposes them. Article 20: AgID, acting as notifying authority, imposes the fines under Article 99(4)(f) and (5) of the AI Act. Article 21: the national market surveillance authorities, each within its own competence, impose the fines on the persons identified by Article 99(1). Under Article 5 those authorities are ACN, Banca d'Italia, Consob, IVASS and, limited to Article 74(8) of the AI Act, the Garante per la protezione dei dati personali.

Expected effect: it moves no 231 figure, and it is the parallel channel already recorded in Bulletin No. 9. What changes is its evidential status: the 7% was reported by a single source in Bulletin No. 10 and is now read on the text of the decree.

Ambiente — D.L. 177/2026, in conversione.

Court of Cassation, Joint Criminal Divisions, Nos. 36525 and 36526 of 16 October 2026 — the open item advances. Two independent qualified commentaries published on 20 October, inside this window, now report the reasoning on profit and on seizure. The original text is still unread.

What the two sources report, concurring. (i) The fraud is an instantaneous offence of damage, and the damage does not require an outflow of money from the public purse: it may consist in any economically appreciable utility, on a dynamic conception of public assets — described by one source as a deminutio patrimonii in an economic and functional sense. (ii) The mere creation of the credit is not enough, because it has not yet entered the sphere of the person entitled under the election; set-off is superfluous, being only a means of using a position already acquired. (iii) The relevant moment is the acceptance of the credit on the Agenzia delle Entrate platform following communication of the election: from that moment the credit is spendable against the Treasury and the unjust profit is realised. (iv) From that moment preventive seizure for the purposes of direct and equivalent confiscation of the profit is available — one source states it is "pienamente esperibile". In the case decided, the review court had annulled the seizure decree on the view that the fraud was merely attempted, which would have excluded equivalent confiscation under Articles 640-quater and 322-ter of the Criminal Code; the Joint Divisions annulled that order and remitted. (v) A good-faith transferee may have the credit's original defects raised against him only on proof of intent or gross negligence.

Effect, unchanged in direction and firmer in evidence. No quota moves: both the offence displaced (Article 316-ter) and the offence substituted (Article 640-bis) sit in the same bracket of Article 24 of Legislative Decree 231/2001. What moves is the date on which the entity's administrative offence begins to run — and therefore the start of the five-year limitation period under Article 22 — and the moment at which the confiscable profit crystallises, which these sources now place at acceptance on the platform rather than at monetisation.

Verification status. Extremes, bench and holding remain read on the Court's own decision pages (Nos. 36525 and 36526). The reasoning is now reported by two independent qualified sources published on 20 October 2026, not by one. The original text has still not been read: the PDF at the Court's own document URL for No. 36526 returns binary content with no extractable text, as the PDF for No. 36525 did last week. Second consecutive failure on the Court's own server. Nothing on confiscation should move on the strength of commentary alone, but the convergence is now strong enough that the item's priority is maintained rather than raised.

Court of Cassation, Third Criminal Division, No. 34744/2026 — no progress. The judgment has still not been read in the original, it is not published on the Court's institutional site, CED/Italgiure was not queried, and no new source appeared in the window. The confiscation-quantification rule (profit = the entire unlawfully obtained public financing where the administration derived no economically appreciable utility) and the survival of the entity's offence beyond the limitation of the predicate offence remain «da verificare». Fourth consecutive week.

Cass. Sez. I n. 31505 e Cass. Sez.

Germany — BT-Drs. 21/6133 (§ 30 OWiG: corporate fine from EUR 10 million to EUR 40 million for intentional offences, from EUR 5 million to EUR 20 million for negligent ones). No sitting week in the window: the bill could not move and did not.

The Bundestag's own 2026 sitting calendar was read: October sitting weeks were 5–9 and 12–16 October; the next are 2–6 November, 9–13 November and 23–27 November, then 7–11 and 14–18 December. The window of 19–26 October contains no sitting week. Unlike the two previous weeks, this negative result carries no information about the bill's prospects. The assessment of Bulletin No. 10 stands unchanged on its own evidence: two consecutive available sitting weeks consumed and a third calendared without the bill, hence «in stallo». Next real check: the sitting week of 2–6 November, whose complete agenda was already read in Bulletin No. 10 and does not contain the bill — so the first week in which it could realistically appear is 9–13 November.

Effect: none. The German ceiling stays at EUR 10,000,000.

Transposition of the three tracked directives — a substantial register correction on Directive (EU) 2024/1203, and no window event.

Directive (EU) 2024/1203 (environmental offences). The register was wrong by omission. Our record carried, for several bulletins, "no transposition step found in any Member State". The European Commission's infringement package of 15 July 2026 sent letters of formal notice to twenty-three Member States for failure to notify complete transposition, each with two months to respond: Belgium, Czechia, Germany, Estonia, Greece, Spain, France, Croatia, Cyprus, Latvia, Lithuania, Luxembourg, Hungary, Malta, the Netherlands, Austria, Poland, Portugal, Romania, Slovenia, Slovakia, Finland and Sweden. Read on the Commission's own press-corner document.

Why this matters more than it looks. The directive is the one whose transposition would raise the ceiling for legal persons to 5% of worldwide turnover or EUR 40 million in each Member State. Four of the ten countries tracked — Germany, Spain, France and Romania — were on that list as of 15 July 2026, which means none of them had notified complete transposition by then. Nothing in the windows since has shown any of them completing it. The register entry is therefore corrected from "no step found" to "formally in default, Commission action pending", which is a firmer negative than the one we were carrying. Italy does not appear on the list.

Directive (EU) 2024/1226 (restrictive measures). No new step in the window. The state of play is that of Bulletin No. 10, including the reasoned opinion to Ireland in the package of 1 October 2026.

Directive (EU) 2026/1021 (corruption). No transposition step found anywhere. With the deadline of 1 June 2028 closed on the primary source in Bulletin No. 9, this remains the expected result.
