Bollettino 231
19 ottobre 2026 · finestra osservata: 12 – 19 ottobre 2026

Estende inoltre l'art.
Legislative Decree No. 186 of 25 September 2026 — Implementation of Directive (EU) 2024/1260 of the European Parliament and of the Council of 24 April 2024 on asset recovery and confiscation (GU Serie Generale No. 241 of 16 October 2026, editorial code 26G00203; entry into force 31 October 2026). Sixteen articles in four Titles, read on the official Gazzetta PDF.
It does not amend Legislative Decree 231/2001, and it creates no offence. The catalogue of predicate offences is unchanged. What it changes is the confiscation regime attaching to offences that are already in that catalogue — and it does so in six distinct channels.
Channel 1 — extended confiscation reaches two offences already in the catalogue. Article 2 amends Article 240-bis of the Criminal Code (confisca in casi particolari) by adding to its list of predicate offences Article 414-bis, Article 635-quater.1 and Article 640-ter, second paragraph. Of these, Article 635-quater.1 (possession, dissemination or installation of means to damage computer systems, introduced by Law No. 90/2024) is a 231 predicate under Article 24-bis, and Article 640-ter (computer fraud to the detriment of the State) is a 231 predicate under Article 24. Article 414-bis (instigation to paedophile practices) is NOT in the 231 catalogue — Article 25-quinquies covers the Article 600-series offences, Articles 601, 602, 603-bis and 609-undecies, not Article 414-bis — so that third addition has no effect on the model. Article 2 further inserts, after the second paragraph of Article 240-bis, the rule that "the court shall order confiscation where it finds a temporal correlation between the time of acquisition of the assets and the period of criminal activity".
Channel 2 — two new general confiscation instruments. New Article 240-ter (Confisca per equivalente dei beni strumentali in casi particolari): confiscation of assets or other benefits at the offender's disposal, "including through an intermediary, for a value equivalent to that of the instrumentality". New Article 240-quater (Confisca dei beni nei confronti dei terzi in casi particolari): confiscation of assets the defendant "has transferred to a person extraneous to the offence" "in order to shield them from the effects of confiscation".
Channel 3 — organised crime, both of which are 231 predicates under Article 24-ter. A new paragraph is added to Article 416 of the Criminal Code: "where the association is directed at the commission of offences punishable by imprisonment of not less than four years", confiscation of the things pertaining to the offence and of their proceeds is ordered. Article 416-bis, seventh paragraph, is supplemented in fine: "where confiscation is not possible, confiscation is ordered of assets at the offender's disposal".
Channel 4 — the confiscation provisions of two predicate families. A new paragraph after the first paragraph of Article 600-septies — the confiscation provision governing the Article 600-series offences, which are 231 predicates under Article 25-quinquies — orders "confiscation of the things which served or were destined to commit the offence" on conviction or on a plea bargain under Article 444 of the Code of Criminal Procedure. The same instrumentality confiscation is added after the second paragraph of Article 648-quater, the confiscation provision for money laundering, receiving and self-laundering, which are 231 predicates under Article 25-octies.
Channel 5 — three sectoral statutes whose offences are in the catalogue. Article 6 adds to Article 74(7-bis) of Presidential Decree No. 309/1990 (criminal association for drug trafficking, a 231 predicate under Article 24-ter(2)) the clause "the provisions of paragraphs 1 and 3 of Article 240-ter and of Article 240-quater of the Criminal Code shall apply"; the same clause is added to Article 73(7-bis). Article 7 inserts a new paragraph 4-quater into Article 12 of Legislative Decree No. 286/1998 (facilitation of irregular immigration, a 231 predicate under Article 25-duodecies): on conviction or plea bargain, "confiscation is ordered of the things which are its product, price or profit". Article 8 amends three articles of Legislative Decree No. 152/2006 that are all expressly referenced by Article 25-undecies of Legislative Decree 231/2001: a new paragraph 4 of Article 255-bis and a new paragraph 4 of Article 255-ter order confiscation of instrumentalities, and Article 259-bis receives a new second paragraph ordering confiscation of the product, price or profit, with its heading replaced by "Aggravating circumstance of business activity. Confiscation".
Channel 6 — private-sector corruption, and this is the most direct one. Article 5 inserts a new Article 2635-quater of the Civil Code (Disposizioni patrimoniali): "by way of derogation from Article 2641, third paragraph, in the event of conviction for the offences under Articles 2635 and 2635-bis, confiscation shall in any event be ordered, including in the cases provided for by Article 240, first paragraph, of the Criminal Code". Articles 2635 and 2635-bis of the Civil Code are predicate offences under Article 25-ter, letter s-bis), of Legislative Decree 231/2001 (400–600 quote for Article 2635(3), 200–400 quote for Article 2635-bis(1), plus the disqualifications of Article 9(2)).
Other provisions, out of perimeter. Articles 3, 4 and 12 amend the Code of Criminal Procedure and its implementing rules (Articles 371-bis, 430, new Article 536-bis; Articles 86 and 104 of Legislative Decree No. 271/1989, the latter on crypto-assets); Articles 10 and 11 introduce pre-confiscation sale (new Article 151-bis of Presidential Decree No. 115/2002, new Article 40-bis of Legislative Decree No. 159/2011); Article 9 inserts Article 24-bis into Legislative Decree No. 159/2011 (Correlazione temporale della confisca); Article 13 extends Article 2 of Decree-Law No. 143/2008 to crypto-assets; Article 14 sets up a crypto-asset wallet management service within the Fondo unico giustizia; Articles 15 and 16 cover statistical reporting to the Commission and financial neutrality.
Expected effect on the model — see §1.2. It changes no 231 ceiling and no figure in the catalogue. It enlarges the confiscation exposure attaching to predicate offences, on six channels, effective 31 October 2026.
Confiscation exposure on predicate offences widens from 31 October 2026, while Article 19 of Legislative Decree 231/2001 stays untouched.
The distinction matters for the model and must not be collapsed. Article 19 governs confiscation against the entity, of the price or profit of the offence, with value confiscation as a fallback and the third-party and restitution savings in its second paragraph. Legislative Decree No. 186/2026 does not touch it. What it does is enlarge the confiscation that attaches to the predicate offence itself — instrumentalities, equivalent value of instrumentalities, assets transferred to knowing third parties, extended confiscation on temporal correlation — across six channels that each land on offences already in the 231 catalogue (see §1.1).
Effect on the model, stated precisely. (i) No 231 pecuniary ceiling moves: not the quota, not the maximum number of quote, not the disqualification durations. (ii) The confiscation estimate for an entity exposed to the affected predicate families understates the real asset exposure from 31 October, because confiscation of instrumentalities and of assets placed with third parties was not previously available on several of them, and extended confiscation now reaches two offences in the catalogue that it did not reach. (iii) The families affected are, concretely: organised crime (Articles 416, 416-bis c.p., Article 74 DPR 309/1990), money laundering and self-laundering (Article 648-quater c.p.), offences against the individual (Article 600-septies c.p.), private-sector corruption (Articles 2635, 2635-bis c.c.), facilitation of irregular immigration (Article 12 Legislative Decree 286/1998), environmental offences (Articles 255-bis, 255-ter, 259-bis Legislative Decree 152/2006), and computer crime and fraud (Articles 635-quater.1, 640-ter(2) c.p.).
This is the same structural point recorded in Bulletin No. 9 for AI and in Bulletin No. 5 for market abuse, in a third guise: the 231 ceilings are not the whole of the exposure, which also lives in parallel channels that bear on the same facts — administrative fines indexed to turnover, and confiscation attaching to the predicate offence.
1.3 Normativa di settore sulle aree di processo
Controllato.
Ambiente — D.L. 177/2026, in conversione.
Court of Cassation, Joint Criminal Divisions (Sezioni Unite), judgments Nos. 36525 and 36526 of 2026 — hearing 26 February 2026, deposited 16 October 2026. No. 36525: Pres. S. Mogini, Rapp. G. Liberati; subject matter recorded as offences against property. Extremes, bench and holding read on the Court's own decision page.
Holding, as stated by the Court. (i) The creation of a fictitious tax credit by means of invoices for wholly or partly non-existent transactions, with the election for the invoice discount or the assignment of the credit, may constitute the offence of aggravated fraud for the obtaining of public disbursements under Articles 640 and 640-bis of the Criminal Code — and not, therefore, the lesser offence of undue receipt of public disbursements under Article 316-ter. (ii) That fraud is consummated on the completion of the first assignment — the communication of the election to the tax administration and the acceptance of the credit by the supplier or assignee. Use in set-off, collection, or any further assignment are not required.
Effect on the model: no quota moves. This needs saying plainly, because the headline invites the opposite conclusion. Both the offence displaced (Article 316-ter c.p.) and the offence substituted (Article 640-bis c.p.) are listed in the same provision and the same bracket of Legislative Decree 231/2001: Article 24(1), pecuniary sanction of up to 500 quote, rising to 200–600 quote under Article 24(2) where the entity obtained a profit of significant value or particularly serious damage resulted, with the disqualifications of Article 9(2)(c), (d) and (e). The reclassification therefore does not change the entity's pecuniary bracket.
What it does change, and it bears on figures. (i) The moment of consummation, which fixes the point from which the entity's administrative offence runs — and so the starting point for the five-year limitation period under Article 22 of Legislative Decree 231/2001. Moving consummation forward to the first accepted assignment moves that date earlier, sometimes by years, in every Superbonus-type file. (ii) The confiscable profit. Consummation on the first assignment, irrespective of monetisation, means the profit is in principle crystallised at that point and not at collection — which is the same question, on the same class of predicate offence, on which Cass. Sez. III n. 34744/2026 is reported to have held that the confiscable profit may be the entire unlawfully obtained public financing where the administration derived no economically appreciable utility.
The two items must be instructed together, and neither should be loaded alone. The Sezioni Unite judgment is the higher authority and is certified on the Court's own page; No. 34744/2026 is still a headnote. Priority is now joint.
Verification status. Numbers, division, hearing and deposit dates, bench and the operative holding are read on the Court's institutional decision page — primary. The full text has not been read: the PDF at the Court's own document URL returned no extractable text in this session, and the alternative URL form returned a client error. The reasoning on confiscation and on the quantification of profit is therefore not in hand, and nothing on confiscation should move on the strength of a headline. Judgment No. 36526 is recorded by the Court as deciding the same question; its text has likewise not been read.
Court of Cassation, Third Criminal Division, No. 34744/2026 — the open item does not close this week, and one source weakens.
The organisational-fault holding is further corroborated. A fifth qualified source, a specialist 231 observatory, reports the judgment as Third Criminal Division, 28 September 2026, and adds detail the earlier sources did not carry: the entity's liability is for its own act and not for another's; organisational fault is a typical constituent element, with express reference to Sez. IV n. 32899/2021; failure to adopt or ineffective implementation of the Model is not a constituent element but evidence of organisational fault; the prosecution must prove organisational fault autonomously and specifically, and the entity may prove its absence even without a formal Model; the elements are the organic and teleological relationship with the perpetrator, organisational fault, the predicate offence, and the causal link between the organisational deficit and the offence. In the case itself the Palermo Court of Appeal founded liability on an overall assessment — offence by a senior officer, absence of models, organisational deficit, in particular the absence of an accounting control body — and the appeal alleging merely apparent reasoning was dismissed.
But the two holdings that move figures are, this week, weaker rather than stronger. The same source reports only that the appeals complained of an erroneous determination of the confiscable profit, without reporting the Court's reasoning on that point, and does not address the prescription of the predicate offence at all. So the confiscation rule and the survival of the entity's offence beyond the limitation of the predicate offence still rest on the sources of Bulletin No. 9 and remain «da verificare». The judgment has still not been read in the original; it is not among the decisions published on the Court's institutional site and CED/Italgiure was not queried. It must be obtained before any confiscation figure moves.
Germany — BT-Drs. 21/6133 (§ 30 OWiG: corporate fine from EUR 10 million to EUR 40 million for intentional offences, from EUR 5 million to EUR 20 million for negligent ones). Second available sitting week passed without movement, and the bill is not on the agenda of the next sittings either.
Sitting week KW 42, 12–16 October 2026 — searched and empty. The week's business was the extension of two Bundeswehr mandates, the Frühstartrente, colonial-history motions, the 30th BAföG amendment, the Aufstiegsfortbildungsförderungsgesetz, the digital identity / EUDI wallet bill, care-insurance motions, a government statement on the European Council, a question time, two Aktuelle Stunden and the swearing-in of a new Labour Minister. Neither the OWiG, nor § 30 OWiG, nor the Verbandsgeldbuße, nor environmental criminal law, nor Directive (EU) 2024/1203 appears anywhere in it.
New and forward-looking: the bill is absent from the agenda of sittings 104–106 (4–6 November 2026) as well. The complete Tagesordnung for those sittings was read on the Bundestag's own document: thirty items, including product-liability modernisation, the Abfallverbringungsgesetz, knock-out-drops criminal protection, international criminal law and the ICC — no § 30 OWiG, no 21/6133, no Directive 2024/1203.
Effect on the model: none. The German ceiling in the international base stays at EUR 10,000,000. Documented steps remain those of Bulletin No. 8, ending with the Rechtsausschuss hearing of 6 July 2026 and the Bundesrat position (BT-Drs. 21/6668). Two consecutive sitting weeks and a third calendared week without the bill is, at this point, information: the reform is stalled, not imminent.
Germany — the law transposing Directive (EU) 2024/1260 cleared the Bundesrat on 16 October 2026, the same week Italy published its own transposition. Register entry, not a step.
At its 1069th session on 16 October 2026 the Bundesrat approved, among six laws passed by the Bundestag, TOP 6: Gesetz zur Umsetzung der Richtlinie (EU) 2024/1260 über die Abschöpfung und Einziehung von Vermögenswerten — the German counterpart of Italy's Legislative Decree No. 186/2026. Agenda title read on the Bundesrat's own order of business; the law's text was not read, so its content is not reported here.
Effect on the model: none, and it is not the German step we are waiting for. The asset-recovery directive is not one of the three directives this front tracks, and nothing in the session's agenda touches the OWiG or the Verbandsgeldbuße. It is recorded because the symmetry is useful: both jurisdictions have now implemented the confiscation directive within the same week, which means the confiscation-exposure problem recorded at §1.2 is not an Italian peculiarity and will recur country by country as the base is built out. The session also carried TOP 9 (criminal protection of critical infrastructure) and TOP 34 (the recast European Investigation Order proposal); neither bears on corporate fines.
Transposition of the three tracked directives — one register correction, no window event.
Directive (EU) 2024/1226 (restrictive measures). The EU infringements package of 1 October 2026 — which fell outside the windows of Bulletins Nos. 8 and 9 and was not captured by either — records a reasoned opinion to Ireland for failure to notify any transposition measure, the deadline having been 20 May 2025; Ireland has two months to respond before possible referral to the Court of Justice. Letters of formal notice had already gone out in July 2025 to a larger group. This is a correction to our register, not a change in any ceiling. A transposition tracker consulted this week gives the state of play as: Germany, draft law amending AWG, AWV, AufenthG and ZFdG, tabled August 2025, not adopted; Spain, anteproyecto of an organic law inserting a new Section XXIII-bis into the Criminal Code, approved by the Council of Ministers on 25 March; Romania, draft amending Emergency Ordinance No. 202/2008 with a new Section V-1 on offences; France, within the group of eighteen Member States proceeded against on 24 July 2025 for non-notification. The tracker reports no maximum for legal persons for any of the four, and carries no page update date — its linked document is dated 21 October 2025. Treated as indicative only; it does not displace the primary findings of Bulletins Nos. 4 and 7 on Germany (EUR 40 million fixed, AWG § 19(7), § 30 OWiG unchanged) or of Bulletin No. 9 on France (proposition de loi No. 2544).
Directive (EU) 2024/1203 (environmental offences). No transposition step found in any Member State in the window. The 1 October infringements package does not mention it in the portion read.
Directive (EU) 2026/1021 (corruption). No transposition step found anywhere. With the deadline of 1 June 2028 closed on the primary source in Bulletin No. 9 (Article 37(1); 1 June 2029 for Articles 20(5) and 21), this remains the expected result.
- Cass.
Vedi §8.
- D.Lgs. 184/2026 (ESAP) — voce nuova.
25-septies e art. 25-undecies.
- D.L. 177/2026 — in conversione, A.C. 3133, VIII Commissione Camera, termine 7 dicembre 2026.
